This cookie policy (hereinafter referred to as the ‘Cookie Policy’) governs the use of cookies and social media plugins on the mateco website (https://www.mateco.es/, hereinafter referred to as the ‘Website’). Cookies are small text files that are stored on the hard drive of a device and contain certain information and sometimes personal data. Social media plug-ins are small pieces of software developed and provided by social media service providers (i.e. Facebook, LinkedIn...), which add social media integration when integrated into the Website.

1. WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?

If this happens, we will ask you to take note of the changes and to accept them if you agree to them.

3. WHY DO WE PROCESS YOUR PERSONAL DATA?
We process your personal data through cookies for a number of reasons: to improve our Website and the experiences and services we offer; to display advertisements; to provide information to third parties; and to keep the web experiences we offer, our Website, you and us secure.
3.1 mateco processes your personal data to provide you with more personalised content and advertisements and to perform statistical analysis so that we can improve our Website, online shops, advertisements, products and services or develop new products and services.
3.2 mateco may process your personal data to inform a third party in the event of a possible merger, acquisition/division by that third party, even if that third party is located outside the EU.

4. WHAT MAKES THE PROCESSING OF YOUR PERSONAL DATA LEGITIMATE?
We are required by law to specify precisely what legal basis we use for processing your personal data. TVH obtains your consent via the cookie banner. 4.2 The processing of your personal data for the purposes described in clause 3.3 of this Cookie Policy is also necessary for TVH's legitimate interests, which consist of:
- keep our Website, online shops, Social Media Channels, products and services safe from misuse and illegal activity.
4.3 The processing of your personal data for the purposes described in clause 3.4 is necessary to enable TVH to comply with its legal obligations.
5. WHO RECEIVES YOUR PERSONAL DATA?
Our general approach is that we do not share your personal information with third parties unless you give us permission to do so. However, it is sometimes unavoidable that third parties may receive your personal information. Service providers who assist us in providing the Website to you and entities within the TVH group may receive and process your personal data in certain circumstances.
5.1 TVH relies on external processors to provide you with the Website and to process your personal data on our behalf. Such third party processors may only process your personal data on behalf of TVH upon explicit written instructions from TVH. TVH ensures that all third party processors are selected with due diligence and are obliged to respect the security and integrity of your personal data.
5.2 TVH may share your personal data with other entities within the TVH group of companies. However, we will ensure that all entities within the TVH group of companies ensure that all processing of your personal data complies with this Cookie Policy.
5.3 mateco does not send your personally identifiable information to any third party without your explicit consent to do so. However, mateco may send anonymised and/or aggregated data to other organisations who may use such data to improve products and services, as well as to customise the marketing, display and sale of such goods and services.
6. DO WE TRANSFER YOUR PERSONAL DATA OUTSIDE THE EEE?
Yes, we transfer your personal data outside the EEA (i.e. the European Economic Area, which consists of the EU and Norway, Liechtenstein and Iceland). The parties to whom we transfer our personal data are entities of the TVH group and foreign service providers. It goes without saying that your personal data is safe when we send it to non-EEA countries.
6.1 mateco processes your personal data primarily within the EEA. However, in order to process your personal data for the purposes described in article 3 above, we may also transfer your personal data to other entities within the mateco group or to third parties processing such data on our behalf, located outside the EEA. Each entity outside the EEA that processes your personal data will be obliged to respect appropriate security measures with respect to the processing of your personal data. Such security measures will be the consequence of:
- the host country with legislation in force that can be considered equivalent to the protection offered within the EEA; or
- a contractual agreement between mateco and that entity. All mateco entities are parties to a contractual arrangement based on the EC Standard Contractual Clauses (Controller to Controller) (Commission Decision C(2004)5721).
6.2 mateco may transfer anonymised and/or aggregated data to organisations outside the EEA. In the event of such a transfer, mateco will ensure that security measures are in place to guarantee the security and integrity of your data, as well as all rights with respect to personal data that you may enjoy under applicable mandatory law.
7. WHAT ARE THE QUALITY SAFEGUARDS WITH REGARD TO YOUR PERSONAL DATA?
We will not process more personal data than we need for the purposes we have communicated to you. Furthermore, we will only process your personal data for as long as is necessary to achieve the purposes we have communicated to you or until such time as you revoke your consent to process it and no other legal basis for us to proceed with the processing of your personal data applies. We also guarantee that we will keep your personal data secure.
7.1 mateco makes every effort to process only the personal data that are necessary to achieve the purposes described in article 3.
7.2 Your personal data is only processed for as long as is necessary to achieve the purposes described in Article 3 of this Cookie Policy or until such time as you revoke your consent to process it. Please note that revocation of consent may result in you no longer being able to use all or part of the Website. mateco will de-identify your personal data when it is no longer necessary for the purposes described in article 3, unless it exists:
- an overriding interest of TVH, the payment service provider or any other third party to maintain the identification of your personal data;
- a legal or regulatory obligation or a judicial or administrative order preventing TVH from removing your identification.
7.3 TVH will take appropriate technical and organisational measures to keep your personal data secure from unauthorised access, theft, accidental loss, manipulation or destruction. Access by TVH staff or its third party processors will only be provided to the extent necessary and will be subject to strict confidentiality obligations. However, you understand that security and safety are obligations that can never be guaranteed.
8. WHAT ARE YOUR RIGHTS UNDER THIS COOKIE POLICY?
As a data subject, you have several rights in relation to the processing of your personal data. These rights are the right of access, the right of rectification, the right to withdraw your previously granted consent, the right to erasure, the right to object to the processing of personal data and the right that you receive from us in a structured, commonly used and machine-readable format all personal data you have provided to us.

8.1 You have the right to request access to all personal data processed by TVH and belonging to you. TVH reserves the right to charge an administrative fee for several subsequent access requests that are clearly sent to cause inconvenience or damage to TVH.
8.2 You have the right to request that personal data relating to you which is inaccurate be corrected free of charge. If a request for correction is submitted, such a request must be accompanied by proof that the data is incorrect.
8.3 You have the right to withdraw your previously given consent to the processing of your personal data.
8.4 You have the right to request deletion of your personal data if it is no longer necessary for the purposes described in Article 3 or if you revoke your consent to the processing of your personal data. However, you should note that TVH will evaluate the request for deletion against:
- interests of TVH, your financial institution, the payment service provider or any other third party;
- legal or regulatory obligations or administrative or judicial orders that may contradict such deletion.
Instead of requesting erasure, you may also request that TVH restricts the processing of your personal data if (a) you contest the accuracy of the data, (b) the processing is unlawful, or (c) the data is no longer necessary for the purposes described in Article 3 but you need it to defend yourself in legal proceedings.
8.5 You have the right to object to the processing of personal data if you can prove that there are serious and justified reasons relating to your particular circumstances which justify such objection. However, if the intended processing qualifies as direct marketing, you have the right to object to such processing free of charge and without justification.
8.6 You have the right to receive from us in a structured, commonly used and machine-readable format all personal data that you have provided to us.
8.7 If you wish to submit a request to exercise one or more of the rights described above, you may send an email to info@mateco.pa. An email requesting to exercise a right will not be construed as consent to the processing of your personal data beyond that required to process your request. Such a request should clearly state which right you wish to exercise and the reasons for exercising it, if necessary. It must also be dated and signed and be accompanied by a digitally scanned copy of your valid identity document proving your identity. If you use the contact form, mateco may ask you to confirm this with a signature and proof of identity.
mateco will inform you immediately upon receipt of this request. If the request is valid, mateco will comply with it as soon as reasonably possible and at the latest within thirty (30) days after receipt of the request.
