Privacy Policy

In accordance with Law 81 of 2019 and Executive Decree 285 of 2021 and other regulations on the protection of Personal Data in the Republic of Panama (hereinafter, the "Data Protection Laws"), Mateco Panama, S.A., its affiliates, and subsidiaries (hereinafter, "Mateco", "we", "us", "our"), hereby notify you that, in the ordinary course of our business, we have access to and are responsible for the processing of your Personal Data.

This privacy policy (hereinafter, the "Privacy Policy") governs the processing of your Personal Data during your visit to our website www.mateco.pa (hereinafter, the "Website"), your communication with us via email, telephone, and social media channels (hereinafter, the "Social Media Channels", e.g., Facebook, LinkedIn...), and any order or purchase through one of our online stores (hereinafter, the "Online Stores"; e.g., (Used Material).

For the purposes of this Policy, the term "Personal Data" is defined as any information concerning natural persons that identifies them or makes them identifiable.

NOTE 1: This Privacy Policy does not concern the processing of Personal Data of individuals who choose to apply for a job through our online job application platform. The processing of Personal Data through the job application platform is governed by a separate data privacy statement, available through the platform itself.

  • GENERAL
     
    1. Mateco, with its headquarters via 24 de diciembre, entering through the street of Inadhe in front of the Argos plant, central offices of Mateco Panama, is the company responsible for processing your Personal Data. If you have any questions about this Policy or wish to exercise any rights in accordance with this Policy, please contact us at the following email address info@mateco.pa.
    2. Any term starting with a capital letter will be defined by explicit reference in this Privacy Policy. Whenever possible, given the context, singular terms will also include the plural and vice versa.
    3. When referring to certain laws or regulations, such reference will also include any amendment, replacement, or annulment of such laws or regulations, including related executive decisions.
    4. We reserve the right to modify, change, or edit the Privacy Policy at our discretion and occasionally. Such modification, change, or edit will be communicated through the Website.
       
  • TYPES OF PERSONAL DATA WE PROCESS
     
    1. Each time you use our Website, Online Stores, and Social Media Channels, we collect: • technical information associated with the device you use, such as your IP address, browser type, geographic location, and operating system; • information about your browsing behavior, such as the duration of your visit, which links you click on, which pages you visit, and how many times you visit a page.
    2. When you fill out the contact form on our Website, or contact us via email, phone, fax, or Social Media Channels, we collect: • the basic identity information you provide us, such as your name, email address, postal address, phone number, the company you work for, and your position; • the content of your communication and the technical details of the communication itself (with whom you establish contact, date and time, etc.); • your preferences regarding receiving our email communications, such as newsletters, promotions, announcements, etc., if you have opted to receive such communications and have indicated your preferences in the Preference Center. • publicly available information from your profile on Social Media Channels; • any other personal data you choose to provide us.
    3. When you place an order in one of our Online Stores, as a customer or supplier, we collect: • the basic identity information we need to process your order, such as your name, company, position, postal address, and phone number; • details related to the order itself.
    4. All the aforementioned Personal Data that we receive directly from you. We may receive additional information about your preferences and browsing behavior from partners such as Google, Facebook, Yandex, and AddThis/Oracle. If you need more information about the Personal Data that these parties process about you and make available to third parties, we encourage you to review their respective privacy policies.
       
  • REASONS FOR PROCESSING
     
    1. We process your Personal Data to provide you with the information, products, and services you request through the Website, email, phone, fax, Social Media Channels, and Online Stores in a personalized and efficient manner.
    2. We process your Personal Data for marketing purposes, meaning that we or our selected partners can provide you with personalized communications, promotions, offers, and other announcements. Unless you are an existing customer who has already purchased similar products or services from us and we want to send you our own marketing material, we will only send you communications, promotions, offers, newsletters, and other announcements via email or other personal electronic communication channels if you have explicitly consented to receive such communications, promotions, offers, newsletters, and other announcements.
    3. We process your Personal Data to comply with legal obligations or any reasonable request from competent law enforcement agents or representatives, judicial authorities, agencies, or governmental bodies, including competent data protection authorities. We may transfer your Personal Data to the police or judicial authorities as evidence or if there are justified suspicions of an illegal act or crime committed by you through your registration or use of the Website, Online Stores, our Social Media Channels, or other communication with us.
    4. We may be required to collect and transfer your Personal Data to the financial institution or payment service provider in order to allow them to comply with their legal obligations, such as those related to money laundering and anti-terrorist financing.
    5. We process your Personal Data to perform statistical analyses so that we can improve our Website, online stores, products, and services or develop new products and services.
    6. We may process your Personal Data to preserve our legitimate interests, those of our partners, or a third party as long as your registration or use of the Website, Online Stores, Social Media Channels, or other communication channels can be considered (a) a breach of the applicable terms of use or intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Website, Online Stores, Social Media Channels, or other communication channels (c) a danger to the Website, Online Stores, Social Media Channels, or other communication channels, or to any of us or the underlying systems of our subcontractors due to viruses, trojans, spyware, malware or any other form of malicious code, or (d) in any way hateful, obscene, discriminatory, racist, defamatory, malicious, hurtful, inappropriate, or illegal.
       
  • LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA
     
    1. To process your Personal Data under the conditions described in this Privacy Policy, we, as the responsible party, require your consent.
    2. Processing your Personal Data to process an order you have placed through one of our Online Stores is necessary to establish the agreement between you and us.
    3. Processing your Personal Data for the purposes described in clauses 3.3 and 3.4 is necessary for us to comply with our legal obligations.
    4. Processing your Personal Data for the purposes described in clause 3.1 is necessary for our legitimate interests, which are: • continuous improvements to our Website, Online Stores, Social Media Channels, products, and services to ensure you have the best possible experience; • keeping our Website, Online Stores, Social Media Channels, products, and services safe from misuse and illegal activity; • marketing and promotion of our products, services, brands, a successful overall marketing of our products and services.
    5. Mateco reserves the right to take any form of automated decisions regarding your Personal Data.
       
  • RECIPIENTS
     
    1. We do not send your identifiable Personal Data to any third party without your explicit consent to do so. However, you are aware that if you use our Social Media Channels, your Personal Data will also be processed by social media providers. If you purchase something through our Online Stores, a financial institution or payment service provider may also receive your Personal Data to provide their services.
    2. We rely on external processors to provide you with the Website and Online Stores, as well as to process your Personal Data on our behalf. Such external processors may only process your Personal Data on our behalf based on explicit written instructions provided by us. We ensure that all external processors are selected with due diligence and are required to respect the security and integrity of your Personal Data.
    3. We may share your Personal Data with other entities in our group of companies. However, we will ensure that all entities in our group ensure that all processing of your Personal Data respects what is set out in this Privacy Policy.
       
  • TRANSFER
     
    1. We may transfer your Personal Data for the following business purposes or as described in this Policy: • To the affiliates and/or subsidiaries of Mateco, companies within its economic group, or to its service providers and agents when necessary to comply with an obligation, such as processing transactions and providing services. This will be done confidentially and only to the extent permitted by applicable Data Protection Laws; • To cooperate with public and governmental authorities and law enforcement, and to respond to their requests, or provide the information that is required; • For other legal reasons, such as to monitor compliance and enforce our terms and conditions, to protect our rights, privacy, security, or property, and/or those of our affiliates, you or others, to protect against fraud, crimes, illegal activities, money laundering, or terrorism, and for risk management purposes; and • In connection with business transactions carried out by virtue of the services, or by a business transaction that Mateco carries out with another entity or its advisors in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of the business, assets, or capital stock of Mateco or any of its affiliates, including, without limitation, any bankruptcy or similar proceeding.
    2. The third parties to whom we may transfer Personal Data are only authorized to use the Personal Data provided to them to perform the services for which they were contracted and in accordance with Mateco's instructions.
       
  • QUALITY ASSURANCE
     
    1. We do our utmost to process only the Personal Data necessary to achieve the purposes listed in this Privacy Policy.
    2. Your Personal Data is only processed for as long as necessary to achieve the purposes listed in this Privacy Policy or until you withdraw your consent to the processing, unless we or any other third party have a higher interest in keeping your Personal Data identifiable or if there is a legal or regulatory obligation or a judicial or administrative order that prevents us from doing so.
    3. We will take the appropriate technical and organizational measures to keep your Personal Data safe from unauthorized access, theft, and accidental loss, tampering, or destruction. Access by our staff or the staff of our external processors is only possible on a need-to-know basis and subject to strict confidentiality obligations. You understand, however, that care for safety and security is only an obligation of means that can never be guaranteed.
    4. If you are registered to receive newsletters or other marketing materials, you will be able to unsubscribe from such communications by following the instructions included in each communication.
       
  • YOUR RIGHTS
     
    1. You have the right to request access to any Personal Data we process about you. You must specify which type of processing activity you want to request access to.
    2. You have the right to request that any Personal Data about you that is incorrect be corrected free of charge. If a request for correction is submitted, such a request must be accompanied by proof of the incorrect nature of the data for which correction is requested.
    3. You have the right to withdraw your previously granted consent to process your Personal Data.
    4. You have the right to request the deletion of Personal Data we process about you if such data is no longer required for the purposes described in this Privacy Policy, or if you withdraw your consent for processing. However, you must consider that we will evaluate your request for deletion against: • Overriding interests of Mateco or any other third party; • Legal or regulatory obligations or administrative or judicial orders that may contradict such deletion. Instead of requesting deletion, you may also request that we restrict the processing of your Personal Data if and when: • You dispute the accuracy of such data; • The processing is unlawful, or • The data is no longer necessary for the purposes listed above, but you need it to defend yourself in judicial proceedings.
    5. You have the right to object to the processing of Personal Data if you can prove that there are serious and justified reasons related to your particular circumstances that justify such objection. However, if the intended processing is considered direct marketing, you have the right to object to such processing free of charge and without justification.
    6. You have the right to request a copy of the Personal Data we have processed in a structured, commonly used, and machine-readable format if the processing is based on your consent or a contract with you.
    7. If you wish to submit a request to exercise one or more of the rights listed above, you can send an email to info@mateco.pa. An email requesting the exercise of a right will not be interpreted as consent to the processing of your Personal Data beyond what is necessary to handle your request. Such a request must clearly state and specify which right you wish to exercise and the reasons, if applicable. It must also be dated, signed, and accompanied by a digitally scanned copy of your valid identification proving your identity. If you use the contact form, we may request your signed confirmation and proof of identity.

We will immediately inform you of the receipt of this request. If the request is valid, we will notify you as soon as possible and no later than thirty (30) days after receiving the request.
